Carwash arm pierces car; owner sues

September 5, 2013
KATY, TX — A carwash is facing litigation after a carwash arm fell into a customer’s BMW M6, piercing the vehicle’s hood.

The customer, Dave Billard, says there were no signs and the employees gave him no indication that the carwash had been previously damaged.

"They advised me that someone had just recently damaged the carwash," Billard said in the ABC 13 KTRK-TV story. "I questioned as to why they didn't have it shut down."

Billard said he put in an insurance claim with Landmark Industries, owners of the carwash. He says his claim was denied.

The lawyer assigned to the case says despite the claim being denied the carwash could be in violation of the Deceptive Trade Practices Act.
