PONTIAC, MI — The Michigan appeals court ruled in favor of a carwash here after a customer slipped and fell when he got out of his car, CBSDetroit reported.
The Feb. 21 story stated that customer Eugene Rogers blamed Ultimate Auto Wash for black ice. Rogers said he was “violently thrown to the ground” when he got out of his car at Ultimate to adjust the mirrors.
Carwash off the hook in wrongful death suit
The court said that Rogers could have driven a short distance or rolled down a window to adjust the mirrors. Further, the court noted that anyone with “ordinary intelligence” should realize that water running from cars would likely create ice.
Slip-and-fall lawsuits have become extremely difficult in Michigan courts, the story stated. Rogers’ lawyers said the decision should be left to a jury at trial, not a judge in a higher court.
