OCONOMOWOC, WI — Local developer Pabst Farms Co. has filed a $20 million lawsuit against the City of Oconomowoc. The lawsuit stems from the City Council recently rejecting a conditional use permit for a Kwik Trip gas station and carwash.
Pabst Farms Co. lawyers say the denial is a breach the developer’s agreement by the City Council. At the heart of the suit is a comment made by one city alderperson who voted ‘no.’ According to livinglakecountry.com the alderperson said anything in Pabst must have “blue ribbon” class.
"The city council really acted in an irresponsible fashion," said Pabst attorney Jon Axelrod in the article. He added that using terms "blue ribbon class" in determining a vote "is not an appropriate function of government.”
The city has 120 days to respond to the claim.
