Case against carwash codes goes to court

BLOOMINGTON, MN ― The Minnesota Court of Appeals reinstated a lawsuit against a chain over expiring carwash codes.

BLOOMINGTON, MN ― The Minnesota Court of Appeals reinstated a lawsuit against The Holiday gas station chain over expiring carwash codes, the Minneapolis/St. Paul Business Journal reported.

The March 4 story said the carwash codes, which appear on receipts after a gas purchase, expire within 30 days. Last year, Don Wells sued Holiday Cos. Inc. claiming the time limit is "illegal under a Minnesota law prohibiting expiration dates on gift certificates."

A Hennepin County judge court ruled in favor of the chain, stating that they aren't gift certificates. The case was then thrown out. However, a  three-judge panel has since reversed the judge's decision on appeal and the case is back in court.

Customer sues BP over a carwash code

Clay Halunen, Wells' attorney, stated in the story, "These businesses should not be allowed to take advantage of consumers who think they can’t use certificates that appear to be expired."

Another lawyer for Wells, Susal Coler, stated that customers who purchased carwashes are "entitled to refunds under the law, plus attorney's fees if they have to go to court," the story reported.
