FORT MYERS, Fla. — The city of Bonita Springs and Cardome LLC, a Fort Myers firm, are going to court regarding a proposed carwash on U.S. 41, according to the Naples Daily News.
A lawsuit dated March 14 filed by Cardome LLC in Lee County Circuit Court argues Bonita Spring’s refusal to permit a 6,200-square-foot carwash to be built on a one-acre property between Imperial River and Bonita Beach Road is “unreasonable,” stated the article.
Cardome lawyers explain in the complaint that the City Council “did not properly consider the evidence presented,” reported the article, and denied the request because the use of the property “is not wanted.”
According to the complaint, continued the article, Bonita Spring’s “apparent basis for the denial” hinged primarily on a May 2015 city staff report, and that those “conclusions were ‘nothing more than vague, boilerplate conjectures.’”
City staff recommended to reject Cardome’s rezoning request in its report, informed the article, and noted that the project is not compatible with the surrounding area and would be inappropriate due to the “visual impact” it would have on U.S. 41.
During a March council meeting, added the article, the councilors voted 4 to 3 to reject a special magistrate’s recommendation which noted that the city was being “unreasonable” when it dismissed the Fort Myers firm’s rezoning request.
The carwash dispute started when the City Council voted 4 to 2 to reject the wash last summer, noted the article, the rejection was made despite the city’s zoning board’s recommendation to approve the firm’s request.
